Disclosure Statement Enchanted Realty Brokers are in business to offer real estate services with true honesty and integrity. We will take the time to go through real estate contracts with you and explain real estate options and examples. We do not rush you to hurry and sign. Enchanted Realty brokers are acting with a signed listing agreement representing the sellers of real estate property as transaction brokers. A transaction broker in the State of New Mexico is neither the agent of the seller or buyer. A transaction broker is a middle person that brings the seller and buyer to a meeting of the minds to agree to purchase/sell real estate. Any representation by Enchanted Realty brokers of seller/buyer requires a written disclosure of the agency relationship to both buyer and seller. On the first meeting with any potential customer or client, Enchanted Realty brokers will explain the representation relationship and provide a disclosure form (RANM 1401) that explains and complies with the New Mexico Law regarding the basic duties of a real estate broker. Before any written contract or agreement is signed, Enchanted Realty brokers will provide written disclosure of any material interest, business relationship, or agency relationship involved in the real estate, by the brokers. Note: Effective January 1, 2007 The New Mexico Real Estate Commission rules require all brokers to disclose the brokerage relationships available in New Mexico. The brokerage relationships in New Mexico are 1. Transaction Brokerage. 2. Exclusive Agency. 3. Dual Agency.
In many states the practice of Dual Agency is illegal. Dual Agency is a confusing term and there is no ethical way to perform Dual Agency. Under New Mexico Law Dual Agency contract is modified to the real estate broker performs as a intermediary. Thus, under dual agency contract would act the same manner as transaction brokers. Enchanted Realty brokers will assist buyers/sellers by providing a list of qualified experts for the customer/client to make their own choice of a professional to render their expert opinion as to particular condition of a real estate property.
